Florida Pedestrian Accident Law — What Aventura Walkers Should Know
Florida is consistently among the most dangerous states for pedestrians, and South Florida sees some of the highest pedestrian-fatality rates in the country. Knowing the legal framework before you negotiate with an insurer protects your case.
The Two-Year Statute of Limitations
Under Fla. Stat. §95.11, you generally have two years from the date of the accident to file a personal injury lawsuit, and two years for wrongful death. The deadline was reduced from four years by HB 837 in March 2023.
Pedestrian PIP Coverage
Even though you were on foot, your own auto policy’s Personal Injury Protection (PIP) under Fla. Stat. §627.736 applies if you have one. PIP pays 80% of medical bills and 60% of lost wages up to the policy limit, regardless of fault. Initial care must be sought within 14 days. Pedestrians without their own policy may be able to use a resident-relative’s policy.

Under Fla. Stat. §316.130, drivers must yield to pedestrians lawfully within a marked crosswalk or in an unmarked crosswalk at an intersection. Pedestrians crossing outside crosswalks must yield to vehicles — but drivers still have an independent duty to exercise due care to avoid striking any pedestrian. Florida follows modified comparative negligence under Fla. Stat. §768.81. If you are found more than 50% at fault, you cannot recover.
